I don't see how this is on topic in this. At any rate Red Hat has already clarified it's position on both the interoperability and patent fronts several times now.
The article seemed to be pretty slanted as well. There was no reason given why not making a patent deal with Microsoft should cause people to jump to Novell. In my biased experience the comments I have seen have indicated that people were more likely to drop SUSE for RHEL because of this rather than the other way around.
