IANAL, but I think "just mentioning & adding conditionals" is fine as long
as
source code itself doesn't have patented stuff and so on.
As far as I know, it's fine. Chromium does it, for example. It has a
giant warning in the spec that the conditional should never be enabled
for Fedora builds, but it's there.
