Expectation of privacy
by William Oliver
In another thread, respondents debated the expectation of privacy regarding email. I think this is a reasonable topic for an email mailing list, since there are many differing perceptions.
Of course, laws and customs vary across the world. In the United States, there is a rather complex hierarchy of limitations of scrutiny of electronic communication, particularly by the government. In general, there is:
1) No recgnized expectation of privacy with respect to most header information (to, from, addressing and routing information, etc).
2) No recognized expectation of privacy regarding aggregate information that would be logged by a provider (number of emails sent, websites visited, amount of data transmitted, etc).
3) There is variable expectation of privacy regarding the content of the email.
3a) There is a reasonable expectation of privacy regarding email sent from one person to one other person.
3b) With respect to mailinglist emails, the Supreme Court concluded in US v Maxwell:
"Expectations of privacy in e-mail transmissions depend in large part on the type of e-mail involved and the intended recipient. Messages sent to the public at large in the "chat room" or e-mail that is "forwarded" from correspondent to correspondent lose any semblance of privacy. Once these transmissions are sent out to more and more subscribers, the subsequent expectation of privacy incrementally diminishes. This loss of an expectation of privacy, however, only goes to these specific pieces of mail for which privacy interests were lessened and ultimately abandoned."
4) Finally, emails that are *stored after reading* on a server lose the expectation of privacy. The analogy the courts used was that of a paper letter. A sealed letter delivered to a recipient carries an expectation of privacy. Once the recipient has opened the letter, the expectation of privacy depends on what he or she does with it -- it is the responsibility of the recipient, not the sender. If the recipient puts the letter in a safe, it retains the expectation. If the recipient leaves it sitting on the table and walks away, it loses the expectation of privacy. In the eyes of the court, saving an email on a server constitutes putting it on the desk and walking away. Similarly, abandoned emails lose the expectation, just as abandoned letters do. Thus, email that is stored on a server eventually loses its expectation of privacy even if not read.
In addition, there are differences in *who* can read emails. For instance, while the government may be limited in some instances, a private company can read any communications made by any employee on a company machine, at least if there is notification somewhere.
The effect of warnings, banners, and statements of privacy are variable, depending on the relationship of the sender and recipient. Generally, the banners are effective in removing rather than providing an expectation of privacy. They seem to be meaningless in a practical manner with it comes to multiple recipient emails sent outside a closed organization.
In my profession as a forensic pathologist, I am frequently called to court. Occasionally I, and some of my colleagues, have been surprised to find that emails we sent to mailinglists of various sorts pop up as exhibits when people attempt to challenge our testimony. The admission of these has never been successfully challenged on the basis of expectation of privacy in any of the cases I'm aware of.
Any person who expects that their emails to a mailinglist are private is, at least in the US, doomed to disappointment. If you don't want your emails published generally, don't send them to a mailinglist.

Errors on Boot-Up

Dear Helpers:
When I do manage to boot up my Fedora System, I get these remarks on the
screen:
[ 11.034216] ata5: COMRESET Failed (errno =-16)
[ 21.050448] ata5: COMRESET Failed (errno =-16)
[ 68.199577] ata5: COMRESET Failed (errno =-16)

[ 161.385877] ata5: COMRESET Failed (errno =-16)
[ 171.422106] ata5: COMRESET Failed (errno =-16)
After that, the system goes ahead and boots. The next time, I get the
same number
of errors, but the numbers are different.
Do I need to fix this? How?
Thanks,

Aren't you the one who wrote such beautiful words just for this

Network Manager Problems
by Lawrence E Graves
I have reported the fact that I am having trouble with connecting to my
5ghz wifito bugzilla. Was that the place to report. If not where do I
report this problem. I am running Fedora 19 Beta TC2 on Dell 9400
Inspiron with iwl4965 card which handles 2.4ghz and 5ghz bands. I
replaced the card and then installed Fedora 18 and it worked fine so
that told me it was not my cardbut problem with network manager.

virsh ok with TLS but virt-viewer not
by Fernando Lozano
Hi there,
I folowed instructions on:
http://wiki.libvirt.org/page/TLSSetup
To setup TLS conections to a qemu+kvm host, for remote administration. I
guess I did everything right, because
sudo virsh -c qemu+tls://myhost/system
Works fine. So far every command I tried is ok. Giving the same URL to
virt-manager also works.
But I cannot open any guest console, be it from virt-manager or from
virt-viewer.
If I try:
sudo virt-viewer -c qemu+tls://myhost/system 1
I get an error pop-up telling "Unable to connect to graphics server
myhost:5900"
And from virt-manager, the guest console shows "Connecting to graphical
console for guest" and nothing happens. No error message, not even
timeout. :-( But I can inspect and even change the guest details.
On the guest details, it shows "Display Spice" at addres 127.0.0.1 and
port 5900 with auto TLS port, and no password. Should I change those
settings to get remote access to a guest console? If so, how, as I
cannot find info at either libvirt.org nor virt-manager.org.
If I use a qemu+ssh URL it works for virsh and virt-manager, including
gest consoles, but using virt-viewer won't work even using ssh. So I
suppose something is missing, but I have no idea what.
The end goal is being able to use both virsh and virt-viewer under
Windows, and their README state that ssh connections won't work yet.

HDMI audio stops then starts again?
by Tom Horsley
Just wondering if this sounds familiar.
I installed updates this morning and rebooted to get
the latest kernel-3.8.9-200.fc18.x86_64 running.
I'm using HDMI audio by default and it was working
fine for a few hours then suddenly stopped.
I turned on my receiver and switched to SPDIF
output, and had sound again, so parts of the
sound system were working OK. I tried switching
back to HDMI and "Test Speakers" made a rude noise
once, but never played the test sound, so I switched
to SPDIF again.
About an hour later, I tried HDMI once more and
it was now working flawlessly.
There were no messages in any logs I could find
about anything happening to audio.
Just another in the strange happenings since
I started using 3.8 kernels...

F17 recalcitrant X server
by Beartooth
My wife's machine downstairs (built for us by a friend who speaks
hardware; I do not) has been hitting the Diagonal Screen of Death (DSoD);
it brings up the login screen with both our names, and lets you choose
one. You type in userid and password, and whammo : DSoD.
In that condition it does however let me login over ssh and
become root. I did so, ran yum update (no trouble with that), and did a
reboot. No joy.
I tried startx.
[root@Msgv2 ~]# startx
xauth: file /root/.serverauth.1267 does not exist
[....]
Fatal server error:
xf86OpenConsole: VT_ACTIVATE failed: No such device or address
It referred me to wiki.x.org, where I found only discussions well
over my head. But the directions there recommended trying to configure,
and I tried :
[root@Msgv2 log]# X -configure
Fatal server error:
Server is already active for display 0
If this server is no longer running, remove /tmp/.X0-lock
and start again.
It said :
Please also check the log file at "/var/log/Xorg.1.log" for additional
information.
I did that :
[root@Msgv2 tmp]# rm .X0-lock
rm: remove regular file `.X0-lock'? y
[root@Msgv2 tmp]# cd
[root@Msgv2 ~]# X -configure
_XSERVTransSocketUNIXCreateListener: ...SocketCreateListener() failed
_XSERVTransMakeAllCOTSServerListeners: server already running
At this point, it looks to me like a catch-22 -- wie man's auch
macht, is' es verkehrt.
Can anybody spare me a clue?

Upgrade to 3.8.8-100: now boot loops !
by sean darcy
Upgraded F17 kernel to 3.8.8-100. Now it goes boots though udevd, i.e.
"Welcome" seems to find the devices, though it's hard to tell since
everything goes so fast.
/var/log/messages has no messages from these boot loops.
3.7.9-104 works.
3.8.4-102, but now dies with an fb message that nouveaufb conflicts with
vesa vga, so it's removing the generic driver. But it just hangs there.
Any help appreciated.
